Online gambling licence

Remote gambling in Romania: licensing, authorisation and technical requirements.

Remote (online) gambling in Romania is governed by GEO no. 77/2009, the implementing rules approved by GD no. 111/2016 and recent amendments, including Law no. 141/2025. Like all gambling activities, it may be carried on only under a licence and an authorisation granted by ONJN.

What online gambling means

The law defines online betting as fixed-odds betting organised through internet, fixed or mobile telephone systems, and online gambling as all gambling carried on other than in the physical presence of players, organised and transmitted through those systems, for which the organiser holds a licence and an authorisation.

Websites that offer gambling to players in Romania without an ONJN licence are placed on the blacklist published by ONJN, and players who take part on those websites commit an administrative offence.

Who can obtain the licence

Online gambling organisers receive a Class I licence. It can be held by a Romanian company or by an entity from the EU/EEA or Switzerland with a permanent establishment in Romania. The licence is valid for 10 years and the operating authorisation for one year, renewed annually.

The main conditions are:

  1. the company’s main activity must be organising gambling;
  2. subscribed and paid-in share capital of at least RON 1,000,000 for online gambling (cumulative for each activity requested);
  3. the integrity of directors and beneficial owners, shown by criminal records and declarations;
  4. the guarantee required by law (fixed amounts, different for casino games and for other games);
  5. the technical documentation and certifications required by the implementing rules.

Documents for the operating authorisation

The required documents include:

  • the rules of each game and the internal operating rules;
  • proof of ownership or right to use the platform, game software and equipment;
  • certification of the game software, the theoretical return to player (RTP) and the random number generator by recognised laboratories;
  • proof of connection to ONJN’s monitoring and reporting systems;
  • proof of the guarantee;
  • documents on personal data protection and on anti-money-laundering and responsible gambling procedures (identity verification, self-exclusion).

Fees

Following Law no. 141/2025, the authorisation fee for online gambling is 30% of gross gaming revenue (GGR), with a minimum of €480,000 a year. On top of that come the document analysis fee, the licence issuance fee and the annual contribution to the prevention of gambling addiction. Players’ winnings are taxed by withholding at source, in bands, under the Fiscal Code.
