Intellectual property lawyer

Protecting and exploiting your company’s intellectual assets: trademarks, copyright, software, licences and infringement actions.

The Alina Szilaghi law office helps companies identify, protect and exploit their intellectual assets, from the company name and trademark to software, content and know-how. Where needed we work with external specialists, for example on technical filings or patents.

What we cover

  • Trademarks: clearance, applications to OSIM (Law no. 84/1998) and EUIPO, oppositions and disputes;
  • Copyright: software, content, marketing materials and works created in an employment or contractor relationship (Law no. 8/1996);
  • Industrial designs (Law no. 129/1992) and, where relevant, cooperation on patents (Law no. 64/1991);
  • Contracts: licence, assignment and software development agreements, confidentiality and IP clauses in employment and contractor agreements;
  • Enforcement: notices, negotiations, infringement actions and interim measures under Government Emergency Ordinance no. 100/2005, including online and in e-commerce.

How we work

  1. We take stock of the relevant assets and how they were created or acquired (the chain of title matters).
  2. We propose a protection plan: filings, contracts and internal policies.
  3. We represent the company in negotiations and before the courts or competent authorities.

Software and e-commerce projects often connect with IT, telecoms and media and data protection compliance. For commercial contracts see corporate and commercial law, and for disputes litigation and arbitration. Fees are agreed before work starts (see Fees); book a consultation.

Frequently asked questions

How is a trademark protected in Romania?

Protection is obtained by registration: the application is filed with OSIM for Romania or with EUIPO for an EU trade mark, after checking that the sign is available. Protection generally lasts 10 years from the filing date and can be renewed.

Does copyright have to be registered?

No. Copyright (Law no. 8/1996) arises on creation of the work, including computer programs, but proving authorship and settling who owns the rights, especially with employees and contractors, should be dealt with clearly in contracts.

What can I do if my trademark or work is used without consent?

A notice can be sent, a solution can be negotiated, or an infringement action can be brought, with the possibility of interim measures and preservation of evidence under Government Emergency Ordinance no. 100/2005. The choice depends on the evidence, urgency and the company’s objective.
