The controller of your personal data is Alina Szilaghi Law Office (cabinet individual de avocat), 89 Calea Dorobanților, bl. X3, sc. 1, ap. 2, Cluj-Napoca, Cluj County, Romania (“the office”). For any question about your data, contact us at alina@szilaghi.com or by phone on +40 364 883 552.
This policy explains what data we collect through avocat-alina-szilaghi.ro and through communications with the office, why we use it and what rights you have under Regulation (EU) 2016/679 (“GDPR”) and Romanian Law no. 190/2018.
2. What we collect
- Contact and booking form: name, e-mail, phone, company (optional), area of law, your message, the requested consultation date and time and your browser’s time zone.
- Correspondence: data in the e-mails, messages and calls through which you contact us.
- Clients: data needed for the legal services contract, invoicing and the matter we handle (including documents you send).
- Technical data: IP address and browser information, kept briefly in server logs for security; the form stores the IP address only as a cryptographic hash to prevent abuse.
Please do not send sensitive data (for example health data or criminal records) through the form unless it is needed for us to reply.
3. Why we use it and the legal basis
- To reply and book your consultation — steps taken at your request before entering into a contract (GDPR art. 6(1)(b)), on the basis of the consent you give in the form.
- For legal assistance and representation — performance of the legal services contract (art. 6(1)(b)).
- For the lawyer’s legal obligations — professional records, tax and accounting duties and, where applicable, obligations under Law no. 129/2019 on anti-money laundering (art. 6(1)(c)).
- For website security and abuse prevention — the office’s legitimate interest (art. 6(1)(f)).
- For anonymous visitor statistics — the legitimate interest in understanding how the site is used (see section 6).
We do not use your data for marketing and we never sell it.
4. Professional secrecy
Information you share with us about a legal matter is protected by the lawyer’s duty of professional secrecy under Romanian Law no. 51/1995 on the organisation and practice of the legal profession and the Statute of the profession. The lawyer may disclose it only where the law requires.
5. Who receives your data
- the website and e-mail hosting provider, which processes data on the office’s behalf;
- the office’s collaborating lawyers, who are bound by the same professional secrecy;
- external specialists (tax advisers, auditors), courts, authorities, notaries, bailiffs, experts or translators, only as needed for your matter and with your agreement;
- public authorities where the law requires.
We do not transfer data outside the European Economic Area unless you ask us to (for example to correspond with a foreign court or lawyer) or appropriate GDPR safeguards are in place.
7. How long we keep data
- form messages and correspondence that do not lead to an engagement: up to 24 months;
- client files: for the duration of the engagement and afterwards for the periods required by the rules of the profession, tax and accounting law and Law no. 129/2019;
- server logs: for the period set by the hosting provider for security, usually a few weeks.
8. Your rights
You have the right of access, rectification, erasure, restriction, objection and data portability, and you may withdraw consent at any time without affecting earlier processing. Some rights may be limited by legal obligations and the lawyer’s professional secrecy.
To exercise your rights, write to alina@szilaghi.com. We reply within one month. You may also complain to the Romanian data protection authority (ANSPDCP).
9. Security and changes
The site is served only over HTTPS and the form is protected against automated submissions. Access to messages is limited to the office’s lawyers, who are bound by professional secrecy. We may update this policy; the version in force and its date are shown at the top of the page.
