Maintenance obligation

Who owes maintenance, how much, and how child support is set, increased or ended under Romanian law.

Under the Civil Code, the father and the mother must maintain their minor child, providing what the child needs to live as well as the child’s upbringing, education and vocational training.

Parents must also maintain an adult child who is continuing their studies, until the studies end, but not beyond the age of 26.

Maintenance may also be ordered in favour of a former spouse who, after the divorce, is in need because of an inability to work that arose before or during the marriage.

When a parent owes maintenance, it is set at up to one quarter of the parent’s monthly net income for one child, one third for two children and one half for three or more children (Civil Code, art. 529).

  • Advice on maintenance obligations;
  • Drafting the claim and representation in proceedings to set maintenance for minors, adult children and spouses;
  • Drafting a statement of defence or counterclaim in maintenance proceedings;
  • Drafting claims to change or end maintenance.
