Divorce between spouses of different nationalities

Where the divorce is filed decides which law applies to children, maintenance and property.

For spouses of different nationalities, the most delicate question is which country’s courts have jurisdiction over the divorce. EU law allows the spouses to choose between several countries. However, once a divorce petition is filed in one country, its law will apply to all the couple’s family matters, including arrangements for the children, maintenance and so on.

That is why the choice of country for the divorce must be made carefully, right from the start.

In Romania, for example, both couples in which at least one spouse is Romanian and most foreign couples living here can divorce.
