Debt recovery

Unpaid invoices, loans not repaid, dishonoured cheques or promissory notes — we choose the procedure that fits your documents.

The Alina Szilaghi law office offers companies and individuals legal services and practical guidance for recovering civil or commercial debts.

  • Do you have overdue invoices?
  • Do you have debtors who are not paying what they owe you?
  • Do you hold a cheque or promissory note that was refused for payment?
  • Has a contract not been honoured?

We handle the recovery of any type of debt: loans not repaid on time, sums owed under leases, court judgments or service contracts, and amounts owed for brokerage, supply, services, construction work and so on.

Our debt-recovery services cover:

  • legal advice and representation both before court action (demand letters and formal notices) and before the courts at first instance, on appeal and during enforcement;
  • drafting demand letters to debtors and, where a title exists, starting enforcement — including checks on the debtor’s solvency;
  • drafting court claims (the small-claims procedure, payment orders and ordinary claims) to obtain an enforceable title and recover the debt through enforcement;
  • representation before the competent courts.

To recover debts quickly, companies and individuals can choose between the procedures provided by the Civil Procedure Code: a payment order, the small-claims procedure, or an ordinary claim.

Which procedure is available depends on the documents the creditor holds as proof of the debt — contract, accepted invoices, part payments, balance confirmations, payment undertakings and so on — and we advise you directly on the best procedure to follow.

Debts recovered through these procedures are recovered quickly and at low cost.
