Administrative offences and fines

Challenging a traffic fine

Challenging a traffic police fine report in Romania — deadlines, effects and representation.

A traffic fine is the most common sanction people receive.

There are many reasons: speeding, illegal overtaking, running a red light, failing to give way, not wearing a seat belt, drink-driving and so on.

Anyone who feels the sanction imposed by traffic police was unfair can ask the court to annul it.

With administrative offences, as in other areas, it is best to involve a professional from the start.

Our office can give you the legal support needed to challenge fines and to recover your driving licence if it has been suspended.

  • advice on administrative-offence law;
  • drafting the complaint against the fine report;
  • assistance and representation before the courts;
  • drafting the procedural documents needed during the proceedings;
  • obtaining court certificates for the return of the driving licence.

Good to know

  • A fine report must be challenged within 15 days;
  • You do not need to be present to challenge the fine report;
  • The fee is agreed at the start, in the legal services contract;
  • A complaint generally suspends enforcement of the fine; its effect on additional sanctions (such as suspension of the driving licence) depends on the special law and we assess it case by case.
